SAFETYINC TERMS OF SERVICE

These Terms of Service ("Terms") govern your access to and use of SafetyINC's website, training platform, courses, certificates, and related services (collectively, the "Services").
By creating an account, accessing the Services, enrolling in a course, purchasing a certificate, taking quizzes or examinations, clicking any acceptance button, or otherwise using the Services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms.
If you do not agree to these Terms, do not use the Services.
1. ABOUT SAFETYINC
SafetyINC provides online occupational health and safety training programs, educational materials, assessments, certificates of completion, and related services.
SafetyINC is not a government agency, regulator, enforcement authority, or certification body unless specifically stated otherwise.
2. EDUCATIONAL PURPOSE ONLY
The Services are provided for educational and informational purposes only.
Completion of a SafetyINC course does not:
- Guarantee workplace competency;
- Guarantee compliance with any law, regulation, employer policy, or industry standard;
- Create any professional designation;
- Create any government-issued certification;
- Qualify an individual to perform hazardous work without additional training, supervision, or authorization.
Users remain responsible for applying training appropriately in their workplace.
SafetyINC provides standardized educational content intended to assist users in understanding applicable workplace safety principles.
The Services do not replace workplace-specific instruction, practical training, employer supervision, competency assessments, site orientation, or employer compliance programs.
3. NO PROFESSIONAL ADVICE
SafetyINC does not provide legal, engineering, occupational hygiene, professional safety consulting, or other professional advice through the Services.
The Services are intended solely to provide general educational information and standardized online training.
Users and employers remain responsible for obtaining qualified professional advice appropriate to their workplace, operations, equipment, hazards, regulatory obligations, and compliance requirements where necessary.
4. EMPLOYER RESPONSIBILITY
SafetyINC provides general educational training only.
Employers remain solely responsible for:
- Workplace-specific training;
- Hazard assessments;
- Supervision of workers;
- Compliance with applicable occupational health and safety laws;
- Verification of worker competency;
- Safe work procedures;
- Equipment training;
- Site-specific orientation.
SafetyINC does not assume any duty owed by an employer to its workers.
Nothing in the Services creates an employment relationship, agency relationship, partnership, joint venture, consulting relationship, or assumption of any employer's statutory duties.
SafetyINC does not supervise workers, control workplace activities, conduct workplace inspections, or assume responsibility for workplace safety management.
5. NO MONITORING OR COMPLIANCE OBLIGATION
SafetyINC has no obligation to monitor workplaces, inspect facilities, audit employer compliance, evaluate workplace hazards, verify ongoing worker competency, or ensure continuing compliance with occupational health and safety legislation after course completion.
6. CERTIFICATES OF COMPLETION
Certificates issued by SafetyINC confirm only that:
- The user completed the applicable online training requirements;
- The user achieved the minimum passing requirements established by SafetyINC.
Certificates issued by SafetyINC are evidence only that the identified individual successfully completed the applicable SafetyINC training program and satisfied SafetyINC's assessment requirements at the time of completion.
Certificates do not guarantee:
- Competency;
- Job qualification;
- Regulatory compliance;
- Continued validity of knowledge;
- Employment eligibility.
Employers and regulatory authorities may impose additional requirements beyond completion of a SafetyINC course.
Occupational health and safety legislation, standards, regulations, and regulatory guidance may change over time. Users and employers remain responsible for ensuring ongoing compliance with all laws and requirements applicable to their workplace.
7. USER ACCOUNTS
Users are responsible for:
- Maintaining accurate account information;
- Protecting login credentials;
- All activity occurring under their account.
Users may not:
- Share accounts;
- Allow another person to complete training on their behalf;
- Impersonate another individual;
- Submit false information.
SafetyINC may suspend or terminate accounts that violate these Terms.
8. ACADEMIC INTEGRITY
Users certify that:
- They personally completed all required course material;
- They personally completed all quizzes and examinations;
- Information submitted to SafetyINC is accurate and truthful.
SafetyINC may revoke certificates obtained through fraud, misrepresentation, cheating, account sharing, or other misconduct.
9. FEES AND PAYMENTS
Certain Services, including certificate issuance, may require payment.
All fees are displayed before purchase.
Unless required by applicable law:
- Fees are non-refundable once a certificate has been issued;
- Completed training does not entitle a user to a refund;
- SafetyINC may modify pricing at any time for future purchases.
Payment processing services may be provided by third-party providers such as Stripe.
SafetyINC does not store full payment card information.
10. NO GUARANTEE OF EMPLOYMENT OR COMPLIANCE
SafetyINC does not guarantee:
- Employment opportunities;
- Promotion;
- Regulatory approval;
- Government recognition;
- Acceptance of a certificate by any employer, organization, or authority.
Users are responsible for determining whether a course satisfies their employer's requirements.
11. DISCLAIMER OF WARRANTIES
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."
SAFETYINC MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY;
- FITNESS FOR A PARTICULAR PURPOSE;
- ACCURACY;
- COMPLETENESS;
- NON-INFRINGEMENT;
- UNINTERRUPTED AVAILABILITY.
SafetyINC does not warrant that the Services will be error-free or uninterrupted.
12. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAFETYINC, ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR:
- PERSONAL INJURY;
- DEATH;
- PROPERTY DAMAGE;
- LOST PROFITS;
- LOST BUSINESS OPPORTUNITIES;
- BUSINESS INTERRUPTION;
- LOSS OF DATA;
- INDIRECT DAMAGES;
- INCIDENTAL DAMAGES;
- CONSEQUENTIAL DAMAGES;
- PUNITIVE DAMAGES.
This limitation applies whether the claim arises in contract, negligence, tort, statute, or otherwise.
Users acknowledge that workplace safety depends upon numerous factors beyond SafetyINC's control, including workplace conditions, employer policies, worker conduct, supervision, maintenance practices, equipment, environmental conditions, and compliance with applicable legislation.
IN NO EVENT SHALL SAFETYINC'S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY THE USER FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
13. TIME LIMITATION FOR CLAIMS
To the fullest extent permitted by applicable law, any claim arising out of or relating to the Services must be commenced within one (1) year after the event giving rise to the claim.
14. INDEMNIFICATION
Users agree to indemnify and hold harmless SafetyINC and its affiliates from any claims, losses, liabilities, damages, costs, and legal expenses arising from:
- Violation of these Terms;
- Misuse of the Services;
- Fraudulent activity;
- Violation of applicable laws;
- Reliance on certificates beyond their intended purpose.
15. THIRD-PARTY SERVICES
The Services may integrate with third-party providers, including payment processors, email providers, cloud hosting providers, and analytics services.
SafetyINC is not responsible for third-party services or their availability.
16. PRIVACY
Collection, use, and disclosure of personal information are governed by SafetyINC's Privacy Policy.
By using the Services, users consent to such collection and use.
17. INTELLECTUAL PROPERTY
All course materials, content, graphics, text, videos, examinations, certificates, logos, and software are owned by SafetyINC or its licensors.
Users receive a limited, non-transferable license to access the Services for personal or authorized business use.
Users may not:
- Copy;
- Reproduce;
- Sell;
- Redistribute;
- Modify;
- Reverse engineer;
- Republish;
- Use any SafetyINC content, course materials, examinations, videos, documents, or other intellectual property to train, develop, improve, or validate artificial intelligence systems, machine learning models, large language models, or similar technologies without SafetyINC's prior written consent.

18. SUSPENSION AND TERMINATION
SafetyINC may suspend, revoke, or terminate access to the Services at any time for:
- Violation of these Terms;
- Fraudulent activity;
- Abuse of the platform;
- Legal or regulatory requirements.
Certificate revocation may occur if a certificate was obtained improperly.
19. CHANGES TO SERVICES
SafetyINC may modify, suspend, discontinue, update, or remove any part of the Services at any time without liability.
20. FORCE MAJEURE
SafetyINC shall not be liable for any delay, interruption, or failure to perform resulting from events beyond its reasonable control, including internet outages, cloud service interruptions, cyberattacks, telecommunications failures, natural disasters, labour disputes, governmental actions, or other force majeure events.
21. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta and the laws of Canada applicable therein, without regard to conflict of law principles.
Any dispute shall be brought exclusively in the courts of Alberta, Canada.
22. SEVERABILITY
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
23. ENTIRE AGREEMENT
These Terms, together with the Privacy Policy and any additional policies referenced herein, constitute the entire agreement between the user and SafetyINC regarding the Services.
No oral statements, demonstrations, marketing materials, promotional content, or other communications shall modify these Terms unless expressly incorporated into a written agreement signed by SafetyINC.
